Below is a sample copy of the agreement you will be required to sign.

your credit card deposit, your rental date and time has been reserved.
Enclosed are two copies of the agreement, one marked "ORIGINAL"
and the other marked "COPY".
Please read, answer the highlighted questions and sign the "ORIGINAL"
agreement on the last page. Please
mail the “ORIGINAL” back to us in the self-addressed stamped envelope
provided, by the RESPONSE DATE above. The
“COPY” is for your records.
Rentals
totaling $500 or more require ½ down of the total rental fee, as the deposit.
Rentals totaling less than $500, require $50 down as the deposit.
The agreement contains extremely important operational, safety and other
important information. It is
important to read this agreement in its entirety and be familiar with its
contents. Immediately verify that
all information above is accurate (event address, date, times and phone
numbers). Write in any corrections
above and make sure you have a phone number included, to which you can be
reached the four hours prior to your rental start time.
Any
balance due on your rental will be collected prior to setup.
You may pay the balance due by paying cash, postal money order or by
using one of the following credit cards; Visa or Mastercard.
We DO NOT accept personal checks.
Any refunds due for whatever reason, will be issued as indicated in the
agreement.
Please
consult this agreement for all the specifics concerning your rental.
If you need clarification on any anything contained in this agreement,
feel free to contact us. Additionally, if you need to add, change or subtract
services or options from now until two weeks prior to your rental date, please
contact us, we will be happy to work to accommodate you, if possible.
Any
gratuities given to the delivery person(s) for excellent service are made at the
sole discretion of the client and are not solicited.
In the event refunds are due to the client for whatever reason, refunds
will be issued in the form of a company check, mailed to the client's registered
address, within 10 days.
SAFETY
RULES AND GUIDELINES FOR AMUSEMENT and/or CONCESSION EQUIPMENT
Complete
safety rules and procedures for the unit(s) rented will be verbally explained
and a laminated written safety sheet will be provided to the renter(s) upon
delivery. This safety sheet will remain with the renter until the unit(s) is/are
removed by BREW CITY BOUNCE, LLC. Upon
delivery, renter(s) will be required to sign an acknowledgement form indicating
safety guidelines, rules, troubleshooting and emergency procedures were
explained thoroughly before the unit(s) can be used.
All units should be attended by a responsible adult at least 18 years of
age or older, unless an attendant is contracted through our company.
Children under age 3 are highly discouraged from using inflatable
devices, as motor skills are not fully developed and they lack the coordination
necessary to safely use the unit. Additionally,
users with mental or physical impairment should not be allowed to use inflatable
units. Concession equipment (cotton
candy, sno cone, nacho cheese dispenser and popcorn machines) is rented out as
equipment only. We do not provide operators for concession equipment.
Due to the potential for injury from use of some concession equipment,
they should be attended to and operated by a responsible adult.
PRIVATE
VERSUS PUBLIC USE DEFINED FOR INFLATABLE USE
PRIVATE
use rentals are rentals which you have strict control over whom is using the
unit at all times. Examples of private use would be a private residence birthday
party or a family party at a park. Certain
work events may qualify as a private rental.
You will need a responsible person over the age of 18 to supervise users
of the device.
PUBLIC
use rentals are those which users are charged a fee for use, open to the public
carnivals, block parties, fairs, school events, some work events, units operated
on public ways or property where renter does not have strict control of users,
Etc. Public use rentals require our units to be State registered and open to
possible inspection by the State of Wisconsin during the rental period.
Additionally, our insurers require one of our trained staff members to be
present during its operation. Therefore, pricing has been adjusted accordingly.
Please note that at least a 25 day advanced reservation is required for public
events, so State requirements can be adhered to. BREW CITY BOUNCE, LLC reserves
the right to cancel or modify terms of this agreement, if in our opinion, use of
the unit was misrepresented by renter, as to a public or private rental.
DELIVERY
AND SETUP OF EQUIPMENT:
BREW
CITY BOUNCE, LLC will deliver, set-up, inspect and pick-up the equipment / units
at the above listed address. This is required by our insurer. We do not allow
customers to pick-up or drop off of inflatable and/or dunk tanks.
We will arrive anywhere between 8:00 AM to 11:00 AM to setup your
inflatable or dunk tank.
DELIVERY
RATES:
Our
delivery rates are based on delivery to a specific zip code and are adjusted
frequently due to the volatility of gas prices over the past several years.
Your delivery charge is stated on the invoice for services.
For current delivery rates, visit our website and click on delivery
rates. Delivery rates quoted on our
website are for private rentals without an attendant.
If we are hired to provide an attendant for your event, the delivery rate
is 1/2 of the posted rates. Delivery
times are not guaranteed, as numerous factors can contribute to a late arrival.
We will however, honor your full contracted time of use, if we are not setup by
your scheduled start time.
PICKUP OF EQUIPMENT
We
will arrive anywhere between 7:00 PM and 10:00 PM to remove the inflatable or
dunk tank. If you require a
specific time for pickup for whatever reason, please let us know, so we can
attempt to accommodate your time request.
Renter
must ensure the setup location for the equipment / units is free from debris,
animal feces and sharp objects. Turn
off any automatic sprinklers and make sure the location has been secured, so no
vehicular traffic is present until the units have been completely removed.
All animals must be tied or caged before, during and
after the event. Also look up to ensure there are not tree
branches, power lines or other obstructions, which may become a hazard.
For items such as games, concession equipment and the like, you will be
required to furnish tables or platforms for the use of these items. Some
equipment requires power, please make sure you have adequate power outlets at
the setup location. INFLATABLES: Inflatable units must be setup within 75 feet
from an AC power source. No additional extension cord runs will be used, as it
becomes a safety concern. Additionally,
it violates electrical code and our insurance requirements. If you cannot meet
this requirement, you can rent a power generator from us or you may provide your
own, however it must be accessible at setup time, otherwise we will not setup.
We require an unobstructed walk or other solid pathway of about 4 feet
wide with NO stairs or other obstacles to the setup area, this includes steep
hills and inclines, as inflatable units weigh between 200 lbs to upwards of 500+
lbs. For the safety all your guests, if your considering the use
of name tags or other ID’s, avoid using safety pins. We suggest using wristbands or stickers.
DUNK TANK: The dunk tank requires about 500 gallons of water and takes
about 35-60 minutes to fill dependent upon average city water pressure. You are
responsible to provide water and a hose. The
dunk tank requires an unobstructed 6 foot pathway to the setup location.
Difficult terrain will require us to drive the dunk tank to the setup
location. Renter is responsible for
the enforcement of all rules and safety regulations. Dunk tank rental time
begins once mechanical assembly is complete or at the contracted time, whichever
is later.
We
will be happy to provide indoor services for you. Please ensure the facility of your choice meets or exceeds
these general requirements.
a.
No stairs
leading to the building or inside the building.
If there are stairs, there must be a ramp or elevator access for us.
b.
We are
granted entry to the facility from 1 to 2 hrs prior to the event start time.
c.
All doors
and entry ways are at least 42” wide.
d.
Height
requirements vary by unit. Either
call or see our website for specifics on each unit.
CANCELLATIONS OR CHANGES TO AGREEMENT / WEATHER CANCELLATIONS
WEATHER RELATED ISSUES:***As with any major outdoor event, it is always wise
to make contingency plans, in case the weather does not cooperate and we need to
cancel all or portions of your rental.***
BREW
CITY BOUNCE, LLC closely monitors National Weather Service forecasts and radar
updates prior to your rental taking place.
BREW CITY BOUNCE, LLC reserves the right to cancel your reservations and
return your deposit, if it appears weather conditions will pose risk to the
equipment / units or to the safety of persons. (i.e. rain, mud, high wind,
extreme cold of less than 45 degrees and/or thunder/lightening.
If
this is the case, a representative will contact and inform the renter of the
cancellation via the provided phone numbers.
Please ensure we are able to contact you in at one of the numbers you
provided 1-3 hours prior to your rental period, as we will not be responsible
for missed calls and/or notifications not being made.
If
it is raining or it is expected to rain on the day of your rental, but
conditions are expected to improve by your rental period, you will be contacted
by phone about 1-3 hours prior to delivery.
At this time, you will be asked if you wish to go forward with the
agreement or cancel. If you cancel,
the deposit or any payments made will be returned in the form of a check and
mailed to the renter's address on file within 10 days. If you later cancel upon
delivery, after agreeing to go forward with the rental over the phone, you will
forfeit a portion of your deposit (the listed delivery charge), as an
unnecessary trip charge.
If
the equipment / units are in use and threatening weather conditions develop, we
will attempt to notify you by phone of the potential weather situation.
If possible, we will make efforts to pick up the equipment / units prior
to the threatening weather arriving or provide you instruction to protect the
safety of the users and equipment. When
contacted by phone prior to the rental and advised of potential weather events
that may occur and you decided to continue with the rental, you will be
responsible for an excessive cleaning charge should an inflatable unit be wet
upon pick up. When units are wet, they must be re-set off-site at a later
time for proper drying and cleaning. The
charge for us having to dry bounces off-site due to rain or having been wet with
water is $50 and $125 for obstacle / combo units.
If we fail to advise you of the potential for weather related problems
during your rental, you will not be responsible for the drying charge.
However, once this agreement is executed and monies paid, there is no
refund for any other reason.
WIND:
If sustained wind speed is predicted or actually exceeds 15 MPH and/or wind
gusts are in excess of 25 MPH, INFLATABLE UNITS SHOULD NOT BE USED!
If we determine these wind conditions to be present on the day of your
rental, we will cancel the reservation for safety reasons.
You will be entitled to a full refund of monies deposited, in accordance
with our weather related refund policy. YOU
are ultimately responsible for the safety of the children--DO NOT TAKE ANY
CHANCES!!
ALL
OTHER CANCELLATIONS: General cancellations, not
associated with weather related cancellations, require a 14 day advance written
notice by you or the deposit is forfeited, unless the date cancelled can be
rescheduled with another event. Brew
City Bounce, LLC reserves the right to cancel your event in writing when at
least 30 days in advance of your date.
You will be entitled to a full refund of all monies on deposit with us in
the event we cancel.
CHANGES
TO AGREEMENTS:
We will attempt to accommodate additions or subtraction of services and
changes in time as much as possible, based upon availability of items and/or
delivery schedules for the day. Subtraction
of services or changes to times must take place no later than 2 weeks prior to
your rental date.
NEGLIGENCE, ABUSE, DAMAGE, LOSS OF EQUIPMENT AND EXCESSIVE CLEANING
Renter
agrees to be responsible for any damaged, rendered unusable or missing
equipment, if it is incurred while in the possession of the renter, aside from
normal wear/tear or when not caused by renter or user negligence.
Damage, replacement and/or excessive cleaning fees vary greatly, but are
estimated below.
Brew
City Bounce, LLC will deduct / charge repair or replacement costs, per the terms
and conditions of this agreement, up to the following amounts: GENERAL USE

items in written safety rules on the laminated instruction sheet provided on the
day of rental)

$100 - $2500 for inflatable unit repairs

Up to $8,500 for inflatable unit replacement, if not repairable. (value
dependent upon unit rented)
INFLATABLES:
An inflatable unit's stability requires spikes to be driven into the
ground to a depth of up to 18 inches, ropes tied to poles or trees or use of
sandbags, etc. Some potential
problematic considerations are underground sprinklers, underground TV and
telephone cables. Although most
electric, gas and water lines are buried below 18 inches in depth, we STRONGLY
recommend the renter contact Diggers Hotline toll-free at 1-800-242-8511, in
Milwaukee at 414-259-1181 or in the 262 area code at 262-782-7104.
You may also notify Digger’s Hotline via the internet at www.diggershotline.com.
Digger’s Hotline is a free service that will mark important utilities
to protect our staff and to avoid potential outages in your utility services.
Digger’s Hotline recommends calling at least 3 working days, but no
more than 30 days in advance of your rental date.
BREW
CITY BOUNCE, LLC, its agents and employees is / are not responsible for any and
all damage that may result from the use of any spikes, ropes, sandbags or any
other manufacture approved securing method.
ITEMS
USING WATER: Some of our rental
items require water for operation i.e. dunk tank, duck pond, etc.
BREW CITY BOUNCE, LLC will not be responsible for water related damage
which may be caused by leaks, over-flow, splashing, dumping, empting or other
methods. Please ensure the water
using items you requested have been placed in consideration for possible water
damage.
Renter
agrees to keep unit and it's accessories in the same condition as when received,
except ordinary wear.
ALTERATION AND ATTACHMENT
No
alterations in or attachments to the unit is permitted.
BREW
CITY BOUNCE ATTENDANTS
When
attendants are contracted for, through Brew City Bounce, or when required by
State regulations and/or our insurer, our attendants are responsible only for
the safe operation of the ride and for the safety of its riders.
Our attendants are prohibited from collecting money or tickets on your behalf.
These duties are the responsibility of the renter.
Attendants will shut down ride operations for 20 minutes for each four
hours worked to allow attendants to take a break. Attendants (contracted or provided by renter) must be present
at all times when ride is in use and the appropriate number of attendants for
each ride must be maintained, if the ride is to continue to operate.
Having our attendants present does not change any of the terms and
conditions in this agreement.
PARK
and/or THIRD PARTY LOCATION RENTALS
It
is your responsibility to contact the particular park or facility you wish to
have us set up at for specific requirements they may have.
In
general, we know all parks and most facilities require the unit(s) to have
insurance, which we have, however some individual parks/facilities may require
you to provide proof of insurance or may require us to add the park/facility as
an "additional insured" party to our policy.
If they wish to have proof of insurance, we will provide this to the
requestor at no charge. If they require them to be added as an "additional
insured" party to our policy, our insurer charges us an additional $25 fee
+ a $15 administrative fee. This
cost will be passed on to you.
**It
is your responsibility to check on the specific requirements for the
park/facility you wish to use. Failure
for you to do so may result in having your permit or use of the park/facility
revoked and will result in loss of use of our equipment.
There is NO refund if we are directed to remove or shut down operations
prematurely.
INSURANCE
BREW
CITY BOUNCE, LLC carries general liability insurance coverage of $1,000,000. Our
liability insurance coverage is limited to acts, actions or events that are a
result of our negligence. It is important and necessary that all parties/firms
renting our units, have adequate homeowner's insurance, tenant insurance or
another form of liability insurance to cover either bodily injury and/or
property damage, which might occur to myself, my guests or invitees, from the
use of BREW CITY BOUNCE, LLC's inflatable unit. Parties requesting to be named
as an "additional insured" to our general liability insurance policy
will be required to pay an additional $25 + a $15 administrative fee for this
service.
I
am at least 18 years of age and possess a valid driver's license or ID card
issued by the State of Wisconsin. I further warrant and can demonstrate that I
am duly authorized to represent and to make purchases on behalf of any such
organization, corporation, business, agency or other entity as might be named in
the agreement as the renting party. I understand and acknowledge the activity to
be engaged in through my inflatable and/or equipment rental with BREW CITY
BOUNCE, LLC brings with it known and unanticipated risks to myself, guests and
my invites. Those risks include, but are not limited to: falling, slipping,
crashing, colliding and could result in my injury, illness, disease, emotional
distress, death and/or personal property damage to myself, my guests, or my
invitees. I acknowledge and certify that I have adequate homeowner's insurance,
tenant insurance or other liability insurance to cover either bodily injury or
property damage, which might occur to myself, my guests or invitees from the use
of BREW CITY BOUNCE, LLC's unit I am renting. I have properly represented the
use of BREW CITY BOUNCE, LLC's unit, as to whether this was a private use or
public use rental, as defined above, in this agreement. I voluntarily release,
indemnify, hold harmless and forever discharge BREW CITY BOUNCE, LLC, including
its officers, directors, shareholders, agents and employees from any and all
liability, claims, demands, actions or rights taken, whether personal to me or a
third party, which are related to, arise out of or are in any way connected with
my rental of the BREW CITY BOUNCE, LLC inflatable unit. I agree to reimburse any
reasonable attorney's fees and costs, which may be incurred by BREW CITY BOUNCE,
LLC, in the defense of such liability, claim, demand, action or right of action.
Claims of action and/or lawsuits filed against BREW CITY BOUNCE, LLC are limited
to those filed within the State of Wisconsin. I agree and certify that I've had
sufficient opportunity to read this entire document, that I have, in fact, read
it in its entirety, that I understand its content and that I execute it freely,
intelligently and without duress of any kind. This agreement contains the entire
agreement of the parties hereto. There are no others. Any prior agreements
whether written or oral, promise, negotiations, or representations not expressly
stated herein, shall be of no force or effect. Should action be instituted to
enforce or interpret any or all of this document, the prevailing party shall be
entitled to recover, in addition to its damages, reasonable attorneys fees and
costs.
